TERMS AND CONDITIONS
It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Description

This agreement covers the engagement of Pinner Wedding Photography to take photographs at the wedding of <bride's name> and <groom's name> on 25th July 2022 at:

1. Services Included


a. Pre-wedding

Engagement shoot (date to be confirmed but expected to be early autumn 2021)


b. Wedding Day

Pinner Wedding Photography will provide the following services as part of this agreement:

  • Two photographers, where the lead photographer will be Tim Durham and the second photographer will be <name of second photographer>
  • The second photographer will start at 10am to photograph the bridal party getting ready at [hotel near the venue TBC]
  • The lead photographer will be ready to start photographing from 14:00 at The Swan @ The Globe and will include: 
  • Photographs with the Groom and his father
  • Photographs with the Groom and Groomsmen before the ceremony
  • Photographs of the wedding rings
  • The Bride arriving

  • Both photographers will be ready to start photographing from 15:00 at The Swan @ The Globe and will include: 
  • The wedding ceremony [Starting at 15:00]
  • Signing the register [estimated 15:30]
  • Group shots [estimated 15:45]
  • Photographs with the Bride and Groom at and around the wedding venue
  • The wedding breakfast and speeches [Starting at 17:00]
  • Cutting the cake
  • First Dance [19:30] 
  • General shots of the guests and the venue
  • Additional bride and groom shots as required

c. Wedding Album

The wedding album is included as part of this contract
  • SIM Imaging Professional LayFlat Photo Album
  • 25cm x 35cm
  • 40 pages
  • Leather cover - Thistle
  • Gold embossing -  SARAH & DAVID / JULY 2021

2. Hospitality
The Client will confirm the arrangements for hospitality for the photographers at the reception venue prior to the wedding day. 

3. Services Not Included in this Contract

Wedding album. This will be the subject of a separate contract. 

4. Booking Fee

The Booking Fee of £200 secures the time and services of Pinner Wedding Photography for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation.
Cancellation less than 12 weeks before the wedding will result in the payment in full. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.

5. Payments

Payments are to be made in three stages:
  1. The booking fee - confirms your engagement with Pinner Wedding Photography and reserves your date.
  2. The second payment is made up to 14 days before the wedding. This, along along with the booking fee, represents 75% of the total due.
  3. The final 25% is payable on delivery of the images.
The total fee payable is: £1,950
  1. First payment: £200 the booking fee
  2. Second payment: £1,262 - payable 14 days prior to the wedding
  3. Final payment: £487.50 - payable on receipt/collection of albums/media
No photographs/images will be delivered until the second payment has been paid in full. 
The album will not be delivered until the final payment has been paid in full.
Payment for any additional items including additional edited images or prints is to be made when they are ordered.

6. Your images

The images will be assessed by the Photographers after the wedding and technically unsuitable images (e.g. out of focus, too dark etc.), duplicates or those that do not meet the minimum acceptable standard (as defined by the Photographers) will be discarded.
The remaining images will be subject to post production (at the discretion of the photographers) that may include cropping, exposure adjustment, colour balance adjustments, removal of extraneous items, perspective adjustment etc. 
The edited images will be made available as both high-resolution JPEG files and as medium resolution (typically 1440 x 1080 pixels) on a USB Stick . 
A free web gallery with username and password is available on request. 
The images will be available to the bride and groom for review after the honeymoon (or three weeks after the wedding). 
No images will be made available to third parties or published by the photographers until they have been seen by the bride and groom.
All images will be delivered as JPEG files.

7. Display

Pinner Wedding Photography may display any photographs included in this contract in their studio, web site, portfolio, literature, display areas, exhibitions, competitions, advertising or slide shows.
None of the images may be sold or licensed for commercial gain without the approval of both the Bride & Groom and the Photographers, and will be subject to a separate contract.

8. Image Quality

All image sizes are nominal. The Photographers will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.

9. Retouching

Additional retouching, digital manipulation and artist finishing over and above that described in Section 1 above is available to the Client as an optional extra.

10. Reorders

All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

11. Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. 
It is contrary to the Act for you to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the written permission of The Photographers. 

12. Licence

The Photographers hereby grant the Bride & Groom the rights to create copies of the digital images supplied:

(a) For their personal use  
(b) For use on social media provided that a credit to The Photographers is clearly displayed. 

All other usage is covered by Copyright (see Section 11 above).

13. Artistic Licence

The Photographers shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. You will provide the Photographers with a full list of group shots required (including names where appropriate) at least two weeks before the wedding. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested. 

14. Inclement Weather

The decision on whether to photograph outdoors in the case of inclement weather will be made by the photographers.

15. Force Majeure or Act of God

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

16. Attendance

In the unlikely event of the assigned Photographers being unable to attend your wedding due to unforeseen circumstances we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability. The appointed photographer will be a professional photographer with proven experience of wedding photography

17. Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

18. Cancellation

The Client may cancel this contract at any time by giving written notice to The Photographer/s but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment in full.
Note that we have already made exceptions to this cancellation policy where weddings have been impacted by Covid-19 related policies. This will always be looked at on a case-by-case basis.

19. Negatives/Digital Files

Negatives / digital files remain the property of The Photographers (see section 12 Copyright above).

20. Complaints

Any complaints should first be raised by the Client with the Photographer/s in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Society of Wedding and Portrait Photographers to mediate but only on the basis that its decision shall be final and binding upon both parties.
